Midland considers next steps over The Tailgate's unmet conditions

The Midland City Council planned to discuss the failures city staff said The Tailgate has made in operating as an event venue during its June 11 meeting. The council approved three Specific Use Designations (SUDs) authorizing its operation.

In late 2023, The Tailgate received authorization as an outdoor commercial amusement facility, according to the Midland City Council meeting agenda packet for its June 11 meeting. The other SUDs were for a mobile food vendor park and permitting that allowed the sale of alcohol for on-site consumption in connection with the other two uses.

According to the Midland City Council meeting agenda packet, several conditions required for those special uses have not been met. These include a failure to obtain necessary building permits for on-site structures, including those required to install permanent restrooms; the parking lot has not been paved with asphalt millings as required; and The Tailgate has not obtained temporary land use permits before using exterior auditory devices.

By operating in violation of the SUDs that allow use as an outdoor commercial amusement facility and mobile food vendor park, the alcohol SUD is also rendered ineffective, according to the Midland City Council's meeting agenda packet. This means it operates without the proper authorization to sell alcoholic beverages for on-premises consumption. The discussion will include recommending steps to ensure future compliance or alternative actions.
