MINUTES OF A SPECIAL MEETING OF THE COMMISSIONERS COURT OF MIDLAND COUNTY, TEXAS
Be it remembered that on Monday the 31st day of July 2023 at 1:00 p.m. a special meeting of the Midland County Commissioners Court was called to order in the Commissioners Courtroom, located at the Midland County Courthouse, 500 North Loraine Street, Midland, Texas. The following members were present:
Terry Johnson, County Judge;
Jeff Somers, County Commissioner Precinct No. 2;
Luis D. Sanchez, County Commissioner Precinct No. 3;
Dianne Anderson, County Commissioner Precinct No. 4

1. Discuss and take action on food and beverages at the Horseshoe.
Presented by Ken Olson, Horseshoe Director. The concession stands and soda machines were discussed. The County Judge suggested allowing non-profits to utilize the area as a way for them to raise money. Veronica Morales, Auditor stated the current contract with Coca Cola is with Horseshoe Hospitality. The County would need to get a contract with Coca Cola. Russell Malm, County Attorney joined the conversation.
Motion that we allow Ken to negotiate the contract with Coca Cola to keep the soda fountain machines there at the Horseshoe.

2. Discuss and take action on Horseshoe employee’s positions.

Motion that we approve all of the positions listed on the backup. The Directors position, the Executive Administrative Assistant position, the Marketing Communications Specialist, the Meeting Convention and Event Planner, the Facilities Maintenance Coordinator, and 7 Horseshoe Maintenance Techs. Along with moving 3 of Eddies guys 3 of Facilities which is Eddie, to the Horseshoe.

3. Discuss and take action authorizing Horseshoe Director to sign contracts for events to be held at the Horseshoe.

4. Discuss and take action creating a Community and Economic Development Plan pursuant to Chapter 381 of the Texas Local Government Code.
Presented by County Judge Johnson. Russell Malm, County Attorney explained Chapter 381 of the Local Government Code.
Motion to create a Community and Economic Development Plan pursuant to Chapter 381 of the Texas Local Government Code including the program allow for the making of grants of public money.

5. Discuss and take action entering into an agreement pursuant to Chapter 381 of the Texas Local Government Code authorizing sale tax rebates to Hodges Development Agreement.
Presented by County Judge Johnson and Sarah Harris, Executive Director of the Midland Development Corporation. This is for the Bass Pro Shop that is coming to Midland. Capital investment of $35 million. This is bringing another industry to Midland. The City of Midland has granted 50% rebate over 7 years. Due to the increase of the size Judge Johnson recommends we do what the city has done and extend it to 10 years. Commissioner Anderson expressed concern of offering the same rebate to other businesses that come to that superblock.
Motion to enter into an agreement pursuant to Chapter 381 of the Texas Local Government Code authorizing sale tax rebates to Hodges Development agreement under the same terms as the City of Midland with the exception that it will be for 10 years instead of the 7 years.
